Here are some helpful tips that individuals need to consider prior to applying for a TN visa at a port of entry in United States. When applying for TN status the applicant is required to prove that he or she satisfies all TN visa requirements. The primary requirement is a job offer from an US commercial organization that has vacant positions under the NAFTA listing. Once you obtain a job offer, it???s time to apply for a TN visa. Applying for a self-employed status is not applicable for a TN visa.

As part of their protocol the CBP will call up your employer to confirm your candidature and discuss the terms of employment. Make sure you notify your employer in advance before hand. If your employer sends over someone to facilitate the process then things become much easier for all parties concerned.


Original copies of all required documents, degrees, transcripts etc. must produced along with the application. As an applicant you must make sure that your passport is updated and is valid for the period of your proposed engagement. If not, your TN status will be limited to the maximum validity of your passport. The employer support letter must have the employer???s letterhead in print and the original signature an employee who was given authority of the company to act on its behalf.


An applicant must make only true and accurate statements and avoid giving false information but must quickly and courteously correct an inspector if the latter misunderstood any statement of the applicant during the application. Lying or misrepresenting or hiding information from the CBP officials will attract some serious complications and will probably result in rejection of application and charges of fraud may also be pressed against you. And your chances of a judicial hearing for such cases are non existent.

It is important that applicants have proper online records and these should match the information in their application forms. Thesedays, the CBP officials run online checks on the applicant and their employer as a preliminary check. Often the applicant and the employer are asked to explain differences in online and application data if any significant differences are found.

And, if you have any prior criminal charges and immigration issues, you must have a satisfactory explanation for those as well. For all practical purposes, applicants with proven criminal charges are rejected. If you have priors you will probably require the services of immigration lawyers if you want the CBP to even process your application. After a few years living the American dream you???ll also want to upgrade your TN visa to green card, for that you will need to see a lawyer as well.
